1. Acceptance of These Terms

Welcome to Severedwing. These Terms and Conditions (these "Terms") govern your use of www.severedwing.com (the "Site") and any purchase you make through it. By using the Site or placing an order, you agree to these Terms, along with our Privacy Policy, Shipping Policy, Returns & Refund Policy, and Cookie Policy, each of which is incorporated by reference. If you do not agree, please do not use the Site.

We may update these Terms from time to time. The version in effect when you place an order is the version that governs that order.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order through the Site. By ordering, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Orders

When you place an order, you will receive an email confirming that we have received it. That confirmation is an acknowledgment, not an acceptance. An order is accepted when we ship it.

We reserve the right to refuse or cancel any order for any lawful reason, including suspected fraud, pricing or listing errors, or unavailability of the item. If we cancel an order you have already paid for, we will issue a full refund to your original payment method.

4. Pricing

All prices are listed in U.S. dollars and do not include shipping charges or applicable sales tax, both of which are calculated and displayed at checkout. We work carefully to keep pricing accurate, but errors occasionally occur. If an item's correct price is higher than the price displayed at the time of your order, we will contact you before proceeding and give you the choice to confirm the order at the correct price or cancel it for a full refund.

Prices may change at any time, but changes will not affect orders that have already been accepted.

5. Payment

We accept payment through Squarespace Payments, including the card types and payment methods it supports. Payment is charged at the time your order is placed. By submitting payment, you represent that you are authorized to use the payment method provided. Payment card details are handled by our payment processor and are never stored by Severedwing, as described in our Privacy Policy.

6. Inventory and Availability

Much of what we sell is vintage, handmade, or one of a kind, which means inventory is genuinely limited. An item is not reserved until checkout is complete. In the rare event that two orders are placed for the same one-of-a-kind item, the earlier completed order prevails and the later order will be cancelled and fully refunded. If any item in your order becomes unavailable, we will notify you promptly and refund the affected item.

7. Shipping

We currently ship within the United States. Processing times, rates, carriers, tracking, and what to do about delays or lost packages are set out in our Shipping Policy. Once items are delivered to the carrier, Severedwing is not responsible for shipping delays or lost packages caused by the shipping carrier, as described in the Shipping Policy.

8. Returns

Eligible items may be returned within fourteen (14) days of delivery in accordance with our Returns & Refund Policy, which describes eligibility, non-returnable categories, and how refunds and exchanges work. Certain categories, including opened body care products, burned candles, and items marked Final Sale, cannot be returned for health, safety, or practical reasons detailed in that policy. All items are subject to final sale if Severedwing LLC deems necessary.

9. Vintage Items

Vintage and secondhand items are sold in the condition described in their listings. By their nature, these items are previously owned and may show wear consistent with their age, including patina, fading, small marks, and other characteristics that are part of what makes them what they are. Such age-consistent wear, when disclosed or reasonably apparent from the listing photographs and description, is not a defect and is not grounds for a claim that an item was misdescribed.

We describe vintage items honestly and photograph them carefully. If an item arrives with significant damage or a material condition issue that was not disclosed, our Returns & Refund Policy applies.

10. Product Descriptions

We make every reasonable effort to describe and photograph products accurately. Even so, colors may render differently across screens, handmade items vary naturally from piece to piece, and measurements of irregular objects are approximate. Minor variations of this kind do not constitute a misdescription. If you have questions about an item's condition, dimensions, or materials before ordering, we encourage you to contact us; we are happy to provide additional photographs or details.

11. Intellectual Property

The Site and its contents, including text, product descriptions, photographs, graphics, logos, and the Severedwing name, are owned by Severedwing or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may browse the Site and share links to it, but you may not copy, reproduce, republish, or commercially exploit any Site content without our prior written permission. Nothing on the Site grants you any license or right to use any trademark displayed on it.

12. User Content

If the Site permits you to submit content, such as product reviews or comments, you retain ownership of what you submit but grant Severedwing a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with the Site and our marketing. You agree not to submit content that is unlawful, defamatory, infringing, deceptive, or offensive, and you represent that you have the right to submit whatever you post. We may remove any user content at our discretion.

13. Acceptable Use of the Site

You agree to use the Site only for lawful purposes. You may not:

• Interfere with the Site's operation or security, or attempt to gain unauthorized access to any system or data

• Use bots, scrapers, or other automated means to access the Site or purchase inventory

• Place fraudulent orders or use payment methods you are not authorized to use

• Impersonate another person or misrepresent your affiliation with anyone

We may suspend or terminate access to the Site for violations of these Terms.

14. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, Severedwing disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Some states do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Nothing in these Terms limits any warranty or right that cannot be limited under applicable law.

15. Limitation of Liability

To the fullest extent permitted by law, Severedwing will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or any product purchased through it. Our total liability for any claim arising out of an order will not exceed the amount you paid for that order.

Some states do not allow the limitation of certain damages, so some of the above limitations may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Severedwing and its owners, employees, and agents from claims, damages, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms, your misuse of the Site, or any content you submit.

17. Governing Law and Disputes

These Terms and any dispute arising out of them or your use of the Site are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Monmouth County, New Jersey, and you consent to the jurisdiction of those courts. Before filing any claim, we ask that you contact us first; most concerns can be resolved quickly and directly.

18. Severability and Waiver

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later.
